农村拆迁赔偿范围及补偿标准

一、被安置人口范围内的家人能否得到补偿

根据法律规定,农村拆迁一般情况下属于被安置人口范围内的都可以得到赔偿。然而,对于被安置人口范围内的家人,他们并不算在补偿款内。即使父母死亡赔偿款作为遗产,也只能由儿子继承,儿媳妇无法获得补偿款。

二、农村拆迁赔偿标准

农村拆迁赔偿标准因地方而异,以下仅供参考农村房屋拆迁补偿安置原则和补偿安置标准。

1. 产权确定办法及补偿安置界限:

凡经政府批准或已领取土地使用权证及房屋所有权证的房屋拆迁,应给予补偿安置。

2. 凡在1978年底前建造的房屋,未取得有关手续,但权属清楚,作为历史遗留房产处理,拆迁时按合法房产以实际建筑面积给予补偿安置。

3. 凡在1979年1月1日至1986年12月31日建造的房屋,未取得房屋所有权证,可凭“土地审批手续”或“土地使用权证”给予补偿安置。

4. 凡在1987年1月1日至1990年3月31日建造的房屋,未取得房屋所有权证,可凭“土地审批手续”或“土地使用权证”和当地乡(镇)政府建房手续给予补偿安置。对于无上述手续的情况,但被拆迁人住房确有困难的,由当地乡(镇)人民政府酌情处理。

5. 凡在1990年4月1日以后建造的房屋,未取得房屋所有权证,但已有“土地审批手续”或“土地使用权证”和“建设工程规划许可证”或“村镇建设许可证”(具体时间以当地乡(镇)实施“一书两证”或“一书一证”起始时间而定)的,可给予补偿安置。除此之外,对于无手续的情况,一律视为违法违章建筑物,应在规定期限内一律无偿自行拆除,不给予补偿安置。

6. 拆除未超过批准期限的临时建筑物,按照每平方米30元至50元的标准给予补偿,但不列入安置范围;超过批准期限或未经批准擅自建造的临时建筑物,应在规定期限内一律无偿自行拆除。

7. 上述1至6项中的土地及房屋面积以有关证件上载明的内容为准。如实际的土地及房屋面积与有关证件上载明的建筑面积不符的,经拆迁当事人申请,由县国土资源、房屋拆迁管理部门调查核实后进行裁决。

三、建筑、构筑物拆迁补偿标准

房屋拆迁补偿根据结构年限而定,建筑面积按照《建筑面积计算规则》计算,补偿费包括人工费、材料损失费、装饰费等。具体拆迁补偿标准如下:
